I have a question on Continous 5 yrs Residency requirement to be eligible for ILR. I have asked many friends of mine but I get different answers each time. So posting in this group. Here is my Case.
I entered UK on a 2 yr Work Permit on March 7 2008. I came onsite from India and was working for the same Company also registered in UK. I worked for the same company exactly for 1 year. i.e. From March 7 2008 to March 7 2009 and didn't travel outside UK during this period.
I applied for Tier 1 General Visa in Dec 2008 and got it for 3 years and the start date was Feb 2 2009. I travelled back to India on my Tier 1 General Visa on March 7 2009 as said above.
I came back to UK again on the same Tier 1 General Visa on DEC 13 2010 which means a Gap of almost 1yr 8 months. Since then I have been living in UK extending my Visa until Now.
My question is Will the 1yr residency period when I was on Work Permit be counted for my ILR?
I don't care about the 1yr 8months which I spend in India and I would have anyways become non-resident in UK during this period.
If the 1 yr residency on my Work permit is counted, then I just need to show extra 4 yrs from Dec 2010 and I can be eligible for ILR in Dec 2014.
Can you please let me know if this is possible.?
I am working for a UK Company now from Dec 2013 onwards until now.
