Hi all,

For all those who dont know ... My FTT appeal was dismissed on the basis of this - the landline number having prefix 0203 on the contract... The Judge decided that there is no landline no. with prefix 0203 for london.

My application for the Upper Tribunal appeal is granted saying ...

The appellant has established through the provision of evidence that it is arguable that the error can be established as an uncontroversial error of fact capable of giving rise to an error of law.

So, now what ??

How much time more should it be ??? Will it be a paper hearing or they will call me for an hearing again.

Experienced and those who know about this please advice.

From my UT experience.. You will receive another notice of hearing within 1-3 weeks and your appeal will be MOST likey listed for hearing again (Mine was at the same location FTT) No new evidence will be accepted and the judge(s) will only use evidence from your first hearing.

It usually straight forward and UT judge(s) will scrutinise the FTT determination..I got my decision same day but sometimes they reserve their determination.Good luck and if you have any questions let me know.

Any idea... Will they go through the whole case again or the focus shall be on FTT judgement ?

The judge or judges (there was 3 judges in the room when I went to UT) will start will your grounds of appeal and if there was a error in the FTT decision, will set aside the decision and then look at the case ALL over again to make a new decision!
HO presenting officer might bring up new argument (if there's error in the first decision) and if your lucky and Presenting officer has no argument then it should be straight forward..
