Need help - Brake in Tier-2 and EU Irish child

Post by jaskamalman » Thu Jan 16, 2014 5:08 pm

I may lose my Job 6 months before my 5 years continues work on tier 2 (general) Visa? Can I still apply for ILR (on discretionary)?

I am working in UK for almost 9 years (with a brake in continuity),
I am also a Parent of Irish child born in UK (EU citizen).
I will have a new job offer (from company without licensed).

From 2005 to 2009, I was on work visa.
But in 2009, my visa expired and I had to leave country for few months because my employer didn’t have license to extend my visa.
In Jan 2010, I came back to UK on tier 2 visa and extended It (Now valid until 2016).
Both of us are non EU citizens but our 3 year old UK Born child is Irish citizen (EU national) as we live in Northern Ireland.
So my ILR is due in jan 2015. But there are good chances that, my employer wouldn’t get a new project and I can lose my job in few months. If this happens, I am confident to get new Job offer from another company but I am not sure if they would apply for license to extend my visa.
So, can I still get ILR, or any other kind of extension?
