My Brother's Visa refusal

Post by er.sachin.p » Mon Jan 20, 2014 1:08 pm

Hi,
I am Sachin Pandey , I worked for a company in India, now i am on assignment here in London, I want my brother to come to visit me in london, He applied as General visitor visa from India. His Visa got refuse because of following region:

1. you have sent us a statment provided with the closing balance 357445 INR but the balance on 9 Jan (privouus da) was 7445 , this does not matches you stated income 35,000 in a month, and deposit does not seems to be consistant with the history of your account.
I am not satisfy that you planned to leave UK after completing your visit. Paragraph 41 sec 1 and 2.

how ever he has booked his return tickets already from 13 March to 18 FEB and also i am showing as Partal sponser. Now i have two questions :

1. Can he appeal against it, if yes how much time it does it take.
2. Can he apply again in fast track immidiatey . Visa get rejected on 17-Jan-2014

Quick response will be helpful

Thanks,
Sachin Pandey

Your brother need to make sure he provide a bank statement of the account where his monthly salary is credited. Also he need to provide them with payslips to show them that he is full time employed in india and intending to return after his holiday.

Also get a letter from his employer confirming that he is visiting you and taking a leave for that period. After all these additional documents, I would suggest reapplying again as I am sure if you are allowed to appeal outside the country( this is just my guess, I am not 100% sure) even if you are allowed it will definitely will not be decided with in the timeline you want your visa

Just read your post again and I see one of the rejection reason being

1. you have sent us a statement provided with the closing balance 357445 INR but the balance on 9 Jan (privouus da) was 7445 ,

which probably means you submitted a statement showing balance of 357,445 but when UKBA checked the balance with your bank it was 7445. Did you actually withdraw 300,000 before they made the decision.

If yes, then you will have to submit the new bank statement and make sure you don't withdraw funds till decision is made.

I dont know any other means of fast tracking visitor application. you can write them a covering letter with your resubmission but I am not sure if that will speed the process.

That clearly shows that you made the deposit for the visa. UKBA are aware of such transactions that's why caseworker was not satisfied.

If you have any other bank account where you have maintained high balance for the last 3-6 months, that would also help you. submit that statement along with your salary credit statement and explain the situation in detail in your covering letter
