Missing passport arrival stamps - ILR

Post by igb » Wed Jan 15, 2014 1:40 pm

Hello,

I plan to apply for indefinite leave to remain on the basis of long residence.

As part of this application, you are asked to provide all dates which correspond to you entering or leaving the UK, so that the UK Border Agency can count how many days you've been outside the UK for, to check if you meet the requirements.

I've kept pretty good personal records regarding dates I've entered and left the UK on. However, looking at my passports which cover the entire 10 year period, I have noticed that 2 out of 14 of my entries into the UK are not covered by passport stamps. Furthermore, I've made a subject access request, and the UKBA/Home Office only has my initial landing card on file. I have no other relevant travel documents that might provide additional evidence such as tickets, landing cards etc. My question is, is this likely to cause an issue when making an indefinite leave to remain application on the basis of long residence? Should I seek professional legal advice or am I worrying needlessly?

Thanks,
igb

Hello,

Sorry for bumping this topic, but I could really use some advice regarding my above issue, preferably as soon as possible as my current leave to remain expires soon. Thanks.

If you have passports covering the entire period, no further evidence should be requested. Just stipulate the absences, if they do not exceed the allowed amount (6 months at one time, max total of 540 days) then I don't see an issue. If you wish to provide evidence of residency during the period, that's up to you, something like a bank statement, wage slip or education correspondence would suffice.
