Move to the US?

Post by Aidanmccarthy » Tue Jul 03, 2007 12:13 am

Hi
I am from the UK and have a girlfriend in the US. She was recently refused entry to the UK, due to the fact that she said she was going to work (which is obviously not allowed as a tourist) and was refused a visitors visa as they felt she did not have enough ties to the US.
All I want at the moment is to be with her but also realize the fact that I would need work to survive if I wanted to go to the States.
I have strong ties here as I own a pub.
This is as much a question of what could I do legally to make this work or any ideas of a plan. (I am still young, 22)
Thanks for any advice or ideas.
Aidan
PS I am a british citizen, but have a German passport and can apply for an Irish one as my father is From Ireland.

Hi, the fact that your girlfriend was denied entry in the past should not be an obstacle to her moving to the UK with a spouse or fiancee visa. Keep in mind the following

1. You will most likely need to get married if you want to move to the US or if she wants to move over here.
2. It would be easier for you to get married in the US, but it would be more difficult for you to move over there than for her to join you here, once you are married. Getting an immigrant visa for the US takes much longer and requires much more paperwork than getting a spouse visa for the UK.
3. You won't be allowed to work if you go to the US, unless you go there with a fiance visa (K1) or a spouse visa (K3, immigrant visa).
4. If you go for the spouse visa to the US I would advise you to get the full immigrant visa, not the K3, since the processing times are very similar.
