FLR O DISCRETIONARY LEAVE EXTENSION

Post by soma7474 » Fri Jan 24, 2014 2:21 am

HI

My friend enter in UK under the age of 18. Home office granted discretionary leave in 2011 for three years. His three year is completing in march 2014.

Can he apply for extension of stay in UK under discretionary leave?

Which form he will use for extension?

Which documents required for extension of the discretionary leave in this category?

Experts early response is highly appreciated.

Many Thanks

FLR(O) extension, for a further 3 years, after 6 years DLR (or 10 years legal residence) s(he) can apply for settlement. No particular extra documents should be required, however, a good statement by the applicant explaining that circumstances are similar (if they are) should allow for an extension.

In the statement emphasize a strong link to the UK, that the UK is his/her home all friends and life is here etc...

Quite a simple one, explain the time spent in the UK (I am assuming not all was legal), the close ties/connections he has with friends family and centre of life in the UK. Explain that his family life needs are in the UK, bare in mind:
276ADE (1) wrote:(vi) subject to sub-paragraph (2), is aged 18 years or above, has lived continuously in the UK for less than 20 years (discounting any period of imprisonment) but has no ties (including social, cultural or family) with the country to which he would have to go if required to leave the UK.
