T2 salary confusion!

Post by apex221 » Fri Jan 24, 2014 4:02 pm

I am extending my tier 2 for another 3 years.
Does my salary have to match the code of practice for the job or what was suppose to be paid on my initial COS for the last 3 years?

Please help visa guru :)

Thank you for your reply.

I have read the document but I still can't find the information.

The issue I have is I earn higher than the salary quoted on code of practice but lower than the salary which was initially quoted on my first COS.

Now I am extending for 3 years so I need to know if this will be an issue for extension.

Please help!

Hi Manci,

No I still hold the same job and the same Code aswell but due to financial issue the company was going through I had to take a pay cut for 2 years out of the 3.

Is the situation that the CoS for your current period of leave had an appropriate salary stated but this was reduced due to company-wide reductions due to financial difficulties (which is allowed in certain circumstances)?

If this the case it has no bearing on your extension application provided the new CoS states the min. appropriate, or a higher, salary.

Hi Manci,

Thank you for your reply.

Yes, few of the staff members were made redundant but rather than letting me go they still paid me higher salary than allocated on the Code of Practise for my job just to avoid these issues when it came to extension ,so for the year s11-12 and 12-13 I had to take a pay cut of 30% each year.

For the year 13-14, I am earning the same salary as allocated on COS and the new COS allocated for extension is also in accordance to this.

From what I gather it shouldn’t be a problem?

I am going for extension in person, what documents do you recommend taking to support this situation? or do I need to explain at all?

Please let me know I will be so grateful to you.
