Hi,

I came to UK in Nov 2010 (visa processed only nov 2010) along with my family (disabled son and my wife).I came to know only he is disabled in UK and now here he is getting all the treatment and facilities.

My visa which i came was in ICT tier 2 Visa and now its been 3 year 2 months, applied 2 times extension.

Can you please let me know if i would be eligible for ILR, if not can you please advise me if there is any route.

As i have now dependency on this country don't know what needs to be done from my side?

also can you please let me know the companies giving tier 2 general sponsorship are safe to go with provided there rate and conditions?
as my condition is bit unfortunate and critical, so any help would be appreciated..

also any specific time to switch from tier 2 ict and general.

also how long i can stay in tier 2 ict with my current employer?

Unfortunately you are not eligible for ILR if you stay on T2 ICT because your leave did not include a period before 6 April 2010. On the other hand, you can extend your T2 ICT leave as many times as you wish if your employer is willing to continue sponsoring you.

You could switch to T2G any time but only if you change sponsor. After 5 years on T2G you would be eligible for ILR.

These are the points based system rules. I am not able to comment if there may be grounds for you to stay in the UK outside these rules because of your son's disability - this may depend on the nature of his disability and what care or treatment would be available for him in your home country.

do you know is there any change for April 2014 to be applied for tier 2 general.

as you said currently that option is available and would be continuing with same employer untill this year by then would complete 4 years and switch to tier 2 general maybe sometime in sept/oct.
is there anything i need to do immediately or is there any reason for me to panic?

your 5 year ILR clock will only start when you switch to T2G.

In Nov 2020 you will be eligible for ILR on the basis of long residency (10 years) and if you stay with your present employer that long you wouldn't have to switch to T2G.

if you have a T2G CoS you can apply for T2G leave any time within the validity of the CoS.

As to rule changes from April 14 - no crystal ball. Changes, if any, are usually announced mid-March
