I met a Jamaican man in the UK and we had a relationship for 4 years before flying to Jamaica to get married. However, 6 months before we were due to leave the UK to get married, the police stopped him and he was arrested for overstaying. Shocked I contacted a solicitor and we made an appeal for him to stay in the UK until the planned date for our booked flights and wedding and they agreed; he did not have a criminal record anywhere in the world. After flying to Jamaica to get married we applied for a spouse visa to return to the UK, however before I got a response my husband was murdered. Due to the on-going murder trial I have been spending extended periods of time in Jamaica over the last 3 years attending court and sorting out other personal matters relating to the death of my husband. I have rented out my home in the UK and as I run a Ltd company in the UK, I only work when I return for short trips. I pay taxes and have never sort or received any assistance from the government and do not have a criminal record.
During this time I have started a relationship in Jamaica and we have been renting an apartment for the last 18 months. We are talking about getting married this year, but plan to live in Jamaica for most of the year. He has a passport, but has never travelled and doesn't have a criminal record. In light of my first husband’s death and the amount of time we were forced to spend in different countries after getting married, I do not wish to be apart from my new fiancé for any length of time. However, I would like to visit the UK with him so that I can show him the country of my birth and so that he can meet my family and we can have a wedding party. I also need to travel for business purposes and have to attend meetings and events in the U.K. on a reasonably regular basis for short trips, which I would like him to accompany me (additionally) as a work colleague.
I would really appreciate some advice as to what is the best way to go around this:
If I want to initially travel to the UK with my husband (we would be married by the date of travel) for a maximum of 2-3 months would it be best to apply for a normal short term visitor’s visa?
What are the minimum requirements for being his wife and ‘sponsor’, i.e. the amount of savings and minimum monthly income I would need, or his minimum Jamaican wage and amount of savings?
What is the likelihood of his case being denied, or being made difficult due to the circumstances of my first husbands overstaying?
Any other advice would be greatly appreciated. Thank you in advance for your time.
