Tier 2 ICT to Tier 2 General

Post by vaijis » Sat Feb 01, 2014 8:09 pm

Hi there,
I have the below questions can you help on this please...
1) I have a Tier 2 ICT long term staff visa (came to UK in Oct 2011), i have got an offer and they have agreed to sponsor Tier 2 General. Can i switch to Tier 2 General? or is there a cooling of period?
2) In case if there is a cooling of period, Iam planning to change my wife's Visa from Tier 2 ICT dependent to Tier 4 general putting her in a MBA course and then i can be a tier 4 dependent of my wife's visa. Is this possible?
3) From Tier 4 dependent can i switch to Tier 2 general (in UK or from my home country). Is this possible? or still the cooling off period will apply?
4) I really don't want to miss that offer, Is there any way around to take up that offer (mentioned in point 1)? please help..

Thanks a lot..

Regards,
VJ

you cannot switch in-country, you would have to apply from your home country after 12 months cooling-off

Read the T4 policy guidance about how your wife get on T4:
http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf
once she is T4 you can switch if you meet the requirements (quite complicated). Read the PBS Dependant policy guidance para 32 onwards
http://www.ukba.homeoffice.gov.uk/sitec ... olicy1.pdf

3) From Tier 4 dependent can i switch to Tier 2 general (in UK or from my home country). Is this possible? or still the cooling off period will apply?
you can switch in-country but will need a restricted CoS (no cooling-off)

4) I really don't want to miss that offer, Is there any way around to take up that offer (mentioned in point 1)? please help..

Thanks a lot..

Hi Manci,
Apologies for another query on this.

Assume if everything works and my husband get his Tier 2 General. How long will he be allowed to stay in the UK (maximum)? Can we apply for ILR after 5 years?

6 years subject to a sponsor wanting to employ him

yes - note that £35 k salary is required at the time of ILR applications after April 2016
