Non EEA Spouse applying BC

Hi Guys

I am Non EEA Citizen, married to EU Citizen on Dec 2008. Received COA confirming right to work on Feb 2009 and received my 5 yrs EEA Family Resdent Permit on Oct 2009 which expires on Oct 2014. My wife been living in UK Since Jan 2003 and have always been working. Got British Citizen on May 2013.

* Whilst following this board, I have known that, I can actually apply for BC directly, as my EEA Citizen wife also holds BC, although my EEA Family Resident Card expires on Oct 2014.
* I have worked since I received by COA and have full evidence of Exercising EEA Treaty right. My wife have also fully evidence of exercising EEA Treaty right.

Can some please advise if there is any change on system or please can some one confirm if you had success via this route recently.

Your advice is highly appreciated.

What you do is irrelevant. You don't exercise treaty rights. Only EEA national can exercise treaty rights. You are basing the application on your wife.

EEA SPOUSE FOR RC/AWAITING APPEAL HEARING

Hi everyone
i am currently leaving with my partner an EEA member for more than 2years, we made an application sometimes in july 2013 and in december it was refused. lawyer advised the reason was lame and can only be related to my previous application prior to leaving with my EEA partner.

we ahve since filed an appeal within the deadline, however am at a cross road where my partner is unwilling tot get married subject to her conceiving in addition she has a sick mother that is taking most of her time back in netherlands.

as we are not sure of the appeal date yet, my concern is growing as to where this leaves me amidst her current circumstance, also would love to meet with my potential mother in-law at a point.

could someone please advice on what to do?
