tier 2 ICT Short term Start date vs Actual Start date

Post by fujia » Sat Feb 08, 2014 8:51 pm

Hi everyone,
My situation is my visa is Tier 2 intra company transfer short term staff. My visa period is 12 months. On Cos the start date is 1/1/2014 finish date is 31/12/2014. But due to the delay of visa process, my actual start date is 27/01/2014. Does this mean my finished date will be on 26/01/2015? If my finish date has to be on 31/12/2014, is it possible for me to apply for an extension just for a month?

Thank you very much!

you said your visa period was 12 months - from the dates given it seems to be 24 months which is not possible (unless it was a mistake) because the max period for T2 ICT ST visas is only 12+1=13 months

I know. But that's what the visa on passport says. Let's assume it's one year. What is the actual finish date would be?

The expiry date on your visa is wrong.

However, this doesn't alter the fact that your sponsor is not allowed to let you work beyond the work end date stated in the CoS, which is 31/12/2014.

As regards a possible extension of your leave to 12 months counted from the date of your arrival in the UK - even if this were possible (of which I am not sure) you would need a new CoS for the period of the extension.

Oh, I forgot to tell that my salary is £40k annual. It is possible that it's the reason?

"allowed to work" and "having leave" are 2 different things. Technically you have leave until end of 2015 albeit by virtue of an error in your visa. That doesn't mean that you can, and that your sponsor can allow you to, work beyond the end date given in the CoS

The period of grant for T2 ICT ST applicants is 12 months, or the period of engagement as per CoS if that is shorter, + 1 month. That is why I thought that your visa would be valid until 31/01/2015.

The 1 month is for winding up one's affairs prior to departure.
