Post by Rayking » Sun Feb 09, 2014 9:06 pm

Hello,
Pls,this question is on behalf of a friend and I've got no clue.
As a civil partner given 5 years resident permit, when can someone like that apply for indefinite, is it after 3 years or must complete the 5 years?

5 years (given the use of the words 'residence permit' - so I'm assuming EU family member)

Then it depends when they were originally granted their visa.

Prior to July 2012 - 2 years, post that point - 5 years.

a person given leave as a spouse/civil partner of a British citizen would not be given a '5 year residence permit'. This sounds like an application under the EU rules as MPH80 suggested. You need to clear exactly what has been granted so that you can be given the correct advice.
