Tier 2 General Extension

Hi All,

Few questions about Tier 2 General Extension; Any help will be greatly appreciated.

1 - Will A new CoS be assigned to me by my employer?
2 - If No
- How will my company confirm I'm being paid the right salary for my job and I'm still an employee?
- My original soc code (2132) has changed. I now fall under 2139. How will my employer show this?
3 - If Yes
- Will it be the same procedure as if I was switching to T2G freshly?

- Must it be the same job that got me the Tier 2 Visa? (The one put down in my first CoS)
- What if I have changed roles (Same SOC Code. Just different Job Title)

no, but if your SOC code changes then you'll have to make a change of employment applications for which the sponsor may have to do an RLMT.

- What if I have changed roles (Same SOC Code. Just different Job Title)
if the SOC code remains the same it will be an extension application (no RLMT). The job title, which is something internal to the company, is not important provided your job description agrees with what is in the codes of practice for the particular SOC code.

Hi what if I am changing roles and the job description matches my current SOC code but I am being told that I have to do a RLMT because someone has applied for my role and uses a different SOC code. Are these codes tagged to core duties which are still the same for the new role or tagged to the roles names themselves?
This is a grey area here and need some advice on this.

An RLMT, if needed, is done by the company, not you.

The SOC codes relate to the core duties of the job, not the title.

If the core duties and therefore the SOC code remain the same the company doesn't have to do an RLMT before assigning a CoS for the extension.

Of course, if they find a better candidate they can choose not to continue employing you.

However this is not an extension in my case. It is just a case of switching roles. The only caveat is someone has recently applied for his Tier 2 visa in that role with NQF level 6+ SOC because he can no longer apply with an NQF level 4 SOC. This does not apply to me because I have got my Tier 2 code before the 14th of June 2012 and it is valid {Due for extension next year}. I am able to switch into that role seamlessly the only issue is the company does not want to get stuck in a situation where 2 employees in the same role have 2 different applicable SOC codes. Can 2 people work with the same team with 2 different applicable SOC's.

role = core duties = SOC code
if the roles are the same the SOC codes should also be the same
