Hi, I didn't know which forum I was supposed to post this in so decided on this one so apologies if it is in the wrong section.
My question is "my partner came to england in 2002 seeking asylum from Afghanistan, his application was refused and he has now left the country and is applying for a visa in italy. If we were to get married in Italy could he then apply to come back to the UK on a spouse visa?"

Any help would be greatly appreciated. Thank you

You need to tell us bit more in detail..

Are you British or other EU ?

How he went to italy ?

How long you both in relationship ?

What documents you can show prove that this is a genuine relationship ?

I am a British citizen. He got into Italy illegally I.e via france in a lorry. We have been together a year and a half. We didn't live together. I am now planning to move to italy to be with him but I have a business here so don't want to stay therepermanently.

I think it is unlikely you will be able to marry in Italy.

Care to elaborate on why we cant marry in italy? He has beengranted a 3 year human rights visa so can stay in italy for tthat period so why would we not be able to marry?

This is why I said you need to tell us his full immigration history

I think you can get married in Italy

But spouse visa will not be an easy option In this case because . you need strong evidence to satisfy the officer that this is not marriage of convenience

I have seen cases where entry clearance officer issued visa even next day to a failed asylum seeker ( couple had children and 3 years relationship )

Are you able to meet the financial requirement of annual earnings of at least £18,600? Your partner also needs to pass the A1 English test.

Hi,
Yes I earn more than £18, 600 I have my own business in retail. He is currently in Italy on a human rights visa. I visited earlier this month and I'll be going over next month again. My partners English is very good so no doubt he can pass the test as he was living in england from 2002-2013.
