Help required, Home Office withdraw appeal

Post by scraggy » Wed Feb 12, 2014 8:06 am

Dear all,

Just wondering if somebody can help me. My husband was due to appear at court for a Tribunal Hearing. We were actually very glad as we had a strong case and confident it would be successful. At the very last minute, 2 days before the hearing, our solicitor notified us that the Home Office have withdrawn from the appeal and would like to review the case. We were devastated for some obvious reasons

1. The Home Office have been holding my husband's and childrens passport for nearly 2 years now. We do not know when we will get it back.

2. We have paid the appeal fees totalling nearly £500 and solicitor says we cannot get it back as the Home Office have cancelled the appeal process

3. We have paid the solicitor thousands of pounds to represent and handle the case in preparation for the appeal but obviously now this has not gone to court we are at loss and cannot even claim this.

4. |Other money has gone to waste, eg booking of hotel

Anyone have any suggestions? Feeling annoyed with how the Home Office is handling everything.

Many thanks

IF YOU WON THE CASE WITHIN A RESONABLE TIME,YOU CAN TRY TO FORGIVE THE H.O. ,DO NOT MAKE A CLAIM FOR THE THOUSANDS OF FEES.

Thanks. Thing is, we cannot make a claim as this has not been heard in front of a judge.

Just an update, we have still not heard anything from the Home Office. We even asked helped from our local MP who kindly requested things to be reviewed and this prompted Home Office to return my children's passports (as they are now British ....after being refused visa  ). Anyway, lets see if it's another 1 or 2 years wait.

My only worry is that if an emergency happens and my husband will require his passport urgently to travel.
