hey

i have an issue i need consulting. Basically home office curtailed my visa in may 2013 due to college been revoked and i applied with in time. I received a letter from home office that my college is back on list so i decided in end of October 2013 to withdraw my application where I received yet another letter that they have no records of my application. I have the acknowledgment letter that they did received it and had my biometric done. This time they curtailed my visa till January and again I applied with in time.

my question is

i will be eligible for 10 years long residency soon will the curtailment effect it or not?

@ K4, you didnt give enough info about your case, can you clarify the ffg points;
(1) What date was your visa first curtailed and what action did you take to get a new sponsor?
(2) Did you return to the first sponsor after getting info that they are back on HO list? if yes, when is the visa suppose to expire?
(3) Did your visa get curtailed again the second time or what? And what did you do as well?
(4) What is your present situation, pending application or appeal?

thanks for the reply
1) I got the letter in march and visa was curtailed for 3 may and i applied with the new sponsor by 2 may
2) I went to them and they said to withdraw my case as i didn't got any answer from home office till october so i withdraw my case and got a letter from home office that they have no record of my case. i clearly had my biometric done and also have the acknowledgement letter.
3) I tried to contact home office they were unable to do anything and said you have to apply with a new sponsor by 13 january. So i did.
4) My case is still in process with the new sponsor.

@ K4, need more info if you don't mind;
(1) When is the expiry date on your previous visa before first curtailment?
(2) Is your present application with the same sponsor that got their license revoke and then re-issued?
(3) Were you studying all along during the whole problem of curtailment and re-application?

1) it was august 2015
2) no its with different different sponsor
3) ya apart from the time they got there license revoked but i am studying with my new sponsor now

@ K4, from all the information you have stated, you have never overstayed at any time and you always submit fresh application within time frame given by HO, so the curtailment issue will not have any effect on your 10yrs long residency if you meet all other requirement.

When are you due to clock 10yrs?

it will be in September but i will apply early say end of august 'the 28 days rule' will the passport proves my 10 years or do i need to show them anything else?

@ K4, you should get a copy of your SAR record from HO before you make your ILR application as that will give you an insight as to what record HO have about you.

You will have to submit all your certificate of study, appeal letters e.t.c to show that you have always make progression during your stay. You may also submit P60 records of all the jobs you might have done if you have it to proof you pay taxes but you must not have work more than you are allowed to.

@ K4, its your choice if you decide to use a solicitor or not. You should know if you are confident enough to handle your case or if you will be happy for a solicitor to do it for you.

As per the recommendation, its not allow on the forum and its better you consult few in your area and decide which one to go with.
