Effect of Overseas Job on Naturalisation Application.

Post by Xzibit1 » Tue Jul 10, 2007 8:46 am

Hi All,
I am due to apply for Naturalisation as a British Citizen in 10 months time. I am currentlly working in the UK.However I have applied for a job overseas with an International Organisation of which the UK is not a member. If I get the job with the oveseas organisation, they may require me to start on July 1 2008 (due to age restrictons), by which time I would have already sent in my naturalisation application to the HO. On my naturalisation form I will indicate that my current employer is the UK Company I am working for. I was planning to take a 6 month sabbatical to start the new job overseas, such that " technically" I am still an employee of the UK company, so that when the HO call to confirm, they will be told,"Yes I am an employee but on sabbatical overseas". This I hope will enable me meet the requirment of a naturalisation applicant should be employed by a UK company.

Do memebrs think this strategy can work?

Cheers

There is absolutely no requirement that a naturalisation applicant be currently employed.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

You need to be in the United Kingdom on the date that your application is received by the Home Office (as opposed to the date on which it is put in the post by you). Normally, unless you are married to a British citizen, you need to be planning to continue to live in the UK after naturalisation, and although that provision is rarely looked into, it might be if you are apparently living overseas at the time. There is, however, no requirement for an applicant for naturalisation to be employed, or to be employed by a UK company.

I think this refers to section 2.3 in the application form (principal residence / connections with the UK after naturalisation if not married to a British citizen).

Members Thanks, But the HO says if your are to be naturalised, you need to show/hint that the UK will be your permanent home after naturalisation. It appears you can show this by:

1. Staying in the UK either employed or unemployed.

2. Working overseas for a company that is either headquartered or has connections to the UK.

3. Working overseas in Crown Service.

4. Working Overseas for an organisation of which the UK is a member eg WorldBank, Eurpean Union ,IMF etc.

The organisation I have applied to does not have the UK as a member, so that means the HO Case worker may deny me naturalisation based on the fact that;

1. I will/may be working overseas at the time for an Organisation of which the UK is not a member, although I would have applied for Naturalisation in the UK b4 leaving for overseas. This may therefore show that I do not intend to make the UK my main home.

What do you think?

Well, it's pretty obvious, isn't it? Don't tell them you are planning on going overseas after you naturalise.
