EEA4 Retention Of Rights, Separated Now Divorcing

Post by manyeregr83 » Wed Feb 19, 2014 10:15 pm

Hi All,

I would really appreciate your assistance with my issue.
I am currently on an EEA2 non EEA residence permit which expires in April.
My current wife, Polish (has EEA residence card), got married in 2008, separated in 2012, we filed for divorce this month and are waiting for this to be finalised by the courts.
We both have been resident in the UK for last 5 continuous years. We have a 4 year old son who is a holder of a Zimbabwean passport, I have access to him and support financially.
I would like to apply for an EEA4 on the basis of retained rights, I was previously a student, from 2009-2012, and am now in full time employment.
My wife has agreed to provide me with her residence permit to support my application. I cannot provide the marriage certificate and divorce decree as our application was only recently filed with the court.

Could you please advice what documents I would need to support a successful application on EEA4.

Regards
