tier 4 appeal,urgent please.

hi there,my appeal was allowed on 22 feb 2013.upper tribunal sent back my case to ukba to allow me 60 days time to find new sponsor..i received a letter from ukba on june 14 2013 to find a new sponsor and send my cas ,bank statement and passport back in 60 days.I send my documents.i called them on feb 17 2014.they told me they posted back my documents on 9 jan,2014 and gave me tracking number..i havent got documents and royal mail said they have no idea ,where the documents are...so my question is 1) why ukba didnt ask for my biometrics,i done biometrics with my first application in 2011,on which appeal was allowed 2) its been more than month now,so is that mean they have refused my application again,otherwise they should have send me biometric card..plz help me out ..thx very much

Call HO and tell them that you havent receive any documents, then ask them to send you copies of the last decision so that you can decide what action to take next.

During the time your application was with HO, were you studying with your sponsor?

yes i am studying with government college with 98 % attendence..and i called them ,they are playing blame game ..they are saying its royal mail and royal mail saying its home office..i am worried about decision..do i need to enrol biometric or not ..

@ garrychandi, whatever blame game they play, you are not liable to any enforcement until you receive their decision, my advice will be that you should not waste time by waiting for HO, send them a letter by signed for postage requesting that they send you your decision again since you haven't receive the documents they sent you. Its important to have your request in writing and follow up the letter with phone call and they will definitely send you another copy of the decision.

HO might not require further biometric from you since you won appeal in your first application and that appeal is the continuation of your first application thus no need for new biometric.

But one thing that is not clear from your post is why did HO ask you to get a new sponsor/CAS letter when you won your appeal?

Thx very much mate for your reply.i laready send them the letter asking for copy of their decision.here is the whole story.applied for visa renewal on jan4 2011.. Same day service..and got decision on 14 june 2012 .my application was refused becoz my college was close down by then..won appeal in feb 2013 and court asked ho to give me 60 day times to find new sponsor..i send my application on 13 aug 2013 with new statement and cas from london school of business and finance..and rest you know what happened.. I came to uk on advance diploma in sep 2009 .does 5. Year rules applied to me.. Thx again

@ garrychandi, your 5yrs will be calculated base on the time you actually spent studying and not from the visa length issued since you have had curtailment and appeal in between.
