hi can you help me ,i have a daughter 10years and 4months old born in the uk ,and a 2year old and 1year old all born in the uk i just apply on a tform registeration of the 10 years old as a british citizen with all requirement of ukba since 2nd december 2013 and just got an arknowledgement also my lawyer has put in a fro for me and my partner as well as my other children.me and my partner are over stayers and not working at the moment .just want to know if we will be granted and what limit also can we apply through zambrano right.

first get your child british citizenship and then you have a chance to grant. Don't go for zambrano route, it doesn't lead to settlement. Flr(fp) application is the best. When your child got a british citizenship, you have a strong case. Good luck.

Thank you Shondra . But please i sent my daughters registration of British application in 2nd December 2013 and i got an aknowledgement letter from them 17/01/2014 , how long will it take to get the actual passport from them and what do i do after that ,please can anybody with the same experience advice me on this

British citizenship is enough for your child, passport is for travel. Once your child got a british citizenship, tell your solicitor, send a copy of your child british citizenship to UKBA and try to regularise the stay. Once your child got a british citizenship, your case is much more stronger but still you need to fight with home office, its not that easy to grant you immediately. Good luck.

Thanks again Shondra , so how long will it take to get the my daughters registration since 2nd december 2013, and how long will i continue to fight for mine with the Ukba we have done our biometrics two weeks ago .Please help me with an advice as i am not working at the moment and i am finding life very difficault i am waiting to be granted and then find a job to look after my family.

ok My situation is like yours, I have a child who born and lived in uk for 10 years and 4 months, we are overstayers. My child T-application time line: applied 18 october 2013, acknowledgement letter: 21st ocotber 2013 Money taken from my credit card: 21st novemebr 2013, asking further documents (from 0 to age 3): 31st december 2013, send requested document: 7th january 2014, british citizenship approved: 21st january 2014

We applied under 7 years rule in sept 2012 and it was refused on august 2013. We been here 16 years (legally 8 years+ illeaglly 8 years), came as a student. Last week I sent the fruther representation to home office enclosed my child british citizenship photocopy. Lets see what the home office reaction? still need to fight for that. Always be away from any criminal convinction, one day you will be granted.

no worries you will get your child british citizenship soon. It takes roughly 3 months.

I agree that FLR is a good option and should probably be the first application. I would say that the benefit to Zambrano is that it is an EU given right. As long as the UK is part of the EU, the UK must recognise that right. With FLR, the UK can change rules and you have no option but to accept it.

One group looks set to benefit from the changes: overstayers. At the moment the arcane sophistry of the immigration notices that trigger appeal rights mean that overstayers who apply to remain on the basis of residence and family in the UK often have no right of appeal. They are left in limbo. In future, though, as long as they have made a human rights claim if they are refused that will trigger an instant human rights appeal. Judicial review

Where there is no adequate alternative remedy, a person who alleges that a decision made by the Executive branch of government may bring an application for judicial review. The removal of immigration appeal rights will create many more such people, and will therefore increase the number of applications for judicial review at the same time that politicians are trying to reduce the number of applications for judicial review.

Where an application and appeal does raise human rights issues (family migration cases, for example, or long residence in the UK, or where there are vested rights in a course of study or employment) then it looks like a human rights appeal will be possible, with compliance with the Immigration Rules being indirectly argued as described above.

Hi Shondra,

By the grace of the almighty God i just got a phone call from my solicitor today that my daughter has been granted her British citizenship application .Thank you all for all the encouragement and advice. So please from here what will i do waiting for a res-ponce from all the good people who share very good advice .

ask your solicitor first what is the best option for you now? As far as I know need to push home office to grant you and your family because one of your child is british citizenship, if you made a flr (o) application already, send further representation enclosed your child british citizenship photo copy and tell them our circumstances are changed one of my child is british citizenship. Anyway discuss with your solicitor first what he/she saying? You and your family near to the destination. please pass his/her thought to me okay. Good luck. God bless.

Hi Shondra,
He has sent a covering letter and added the copy of my daughters registration certificate to ukba office because my flr(o) is still pending .Because i am not working and both of us are over stayers i am thinking of going through zambrano because it gives you the chance to work but i want to know if they can grant both of us under zambrano any idea or advice as this route also will enable us to claim benefit because of a British child.
