Unique Scenario,Expert advice requested

Dear All,

I applied for German Work Permit(Blue Card Scheme) in German Embassy London in July 2013 which was declined in September 2013.
They gave me right of Appeal ,I went for Appeal and have won it on 20th February 2014 , German Embassy in London have requested me to submit the Passport to get the German visa.

Now the Problem is i have submitted my passport to UKBA for Entrepreneur visa (Tier 1) in October 2013.

Timeline is as follows,
50K Route and funds in my own Account overseas.

Send Application :20th October 2013
Bio Metric given: 4th November 2013
Interview attended on 11th February 2014
and now waiting for final Decision .

My question is if God forbid my UK Visa is refused am i still able to get the Visa from German Embassy in London without having a valid UK Visa ?

Or if they will give me 28 days time whether is that period is still valid to get the visa from German Embassy ?
or do i have to go back home to get the German visa from Home country ?

Please Advice ,

Hi

My friend faced same situation but he applied Canadian visa.

what he did was he informed HO about his plan and request them to withdraw his tier 1 application. HO asked him how much time it

will take to get Canadian visa and his departure plan from the UK.

My friend gave them 5 weeks time so he can get his visa and will travel to Toronto as soon as he gets his passport from Canadian embassy london.

HO returned his document and he got his Canadian visa and went to Canada within 4 weeks after withdrawing.

First make sure how much time german embassy will take to process your visa after submitting your passport and withdraw application and submit your passport to german embassy.

Don't think to apply for german visa from outside uk. Your case was dealt by german embassy london. So get your visa from here.

Brother i really appreciate your detailed answer,

i also want to mention that my PSW visa was expired on 25th October 2013.

if i will withdraw my application then what will be My Legal status ,German embassy might ask for the proof of Legal status In the UK before issuing the German Visa .

if i withdraw the application how long they will give me to leave the country .

and whether that period is still counted as a legal in the UK which can be accepted by German Embassy if i provide them letter given by UKBA .

When your application is pending to HO u r cover be 3c and 3d. It means your stay is legal till withdrawal of the application.

Best thing to do is contact German embassy and ask them about this.(whether they want to see your current valid visa). Tell them about your situation. and ask them how much time embassy will take to return your passport with visa.

Contact HO and tell them about your plans and get advice from them.

Personally i never faced this kind of situation and told u my friend story. and this story is 100 % true. Difference is you want visa from german embassy and my friend got his visa from canadian embassy.

Hi Aliraza, very unique situation bro, its better for you to take the advice from the UKBA first by showing them your German embassy documents (whatever you have to prove your situation) and do the same with the German embassy side by side (by showing them your UKBA documents) and take advice from both and then act sensibly. It would be better if you take their advice in writing (like email or something), I know it's not that easy, but you are in a very unique situation so that's the best I could suggest.
