Switching from dependent to Tier 2 (Employer Sponsered) Visa

Post by northampton2014 » Sun Feb 09, 2014 7:18 pm

Hi everyone,

I was previously on Post study Work visa (expired recently) . My wife has got Tier 2 (Employer Sponsored) Visa therefore I switched to dependent visa. My query is Can I switch to Tier 2 (Employer Sponsored) visa if my employer agrees to provide me the necessary sponsorship (keeping in mind at present I am on dependent visa) ???
I would really appreciate your views on my query.
Many thanks

yes, you can change from PBS dependant status to T2G but will need to apply from your home country with a restricted CoS

Thanks for your reply. At present I am in UK, do I still need to apply from my home country to qualify for Tier2 (Employer sponsred) visa or can I apply from within UK. Thanks

I had a very similar situation in year 2011. We had to go out of UK to apply.
We came to the UK on my husband's Tier 2 general visa for a year in 2010, I was my husband's dependent, then I found a job with sponsorship. In 2011,we went out of the country and applied again. This time I am Tier2 general main applicant, and my husband is my dependant. I am about to extend my soon this year, just want to check if anyone knows when can we apply for ILR, five years count from 2010 or 2011 please??

Regards

if you meet the requirements you will be eligibly for ILR after the date you arrived back in the UK as a T2 migrant (2011)
