Resident Labour Markert Test Failed

Hello all,

After 4 months of struggle I finally found the role and employer who were ready to sponsor me. I joined them and applied for my Tier 2 visa as well. The job was advertised through agency. Initially the agency guy contacted me for the job and I asked him whether the company is willing to sponsor visa or not, to which he confirmed that they will. Before accepting the offer I again contacted the agency to confirm whether they had conducted the Resident Labour Market Test or not to which that *#%$ agent replied that he is into this profession from last 8 years and knows what he is doing. This gave me and my employer a confidence.
I was issued a COS and I applied for my visa and unfortunately it got rejected. Reason : Resident Labour Market Test not conducted as per the UKBA rules. I contacted the agency again for the details and found that they had missed putting the job advert on JobCenter Plus website. The advert, though, was advertised on 7 different websites for almost 2 months.

Now my employer is interested in retaining me. My question/doubt is..

1. Is it possible for my employer to put the job advert again on JobCenter Plus and other websites for 28 days, conduct few interviews and hire me again. They need more people though.

2. Is UKBA going to reject my application again knowing that its the same employer I applied earlier with.

Are there any hurdles in this ??
