Could i be refused for this?

Post by Yazzy » Mon Feb 24, 2014 10:04 pm

I went to court today for my husbands spouse visa refusal
The home office bought up my finances. Judge told her the financials were met and at the time of refusal the ECO was satisfied.
She then told the judge that i had nit submitted a letter from my employer stating my start date, my pay and my job details. I tolf her i had submitted my job contract which had everything. But she said the appendix fm states there should be a seperate letter from the employer stating all this. The judge said thats true but the ECO didnt raise it.

Can i be refused for something that wasnt even in my refusal which i had passed?

The judge told the home office that he believes my marriage is genuine.
Judge did say we didn't write the date my husband returned to india after he overstay in london even though we had put his entry date and his home office reference number
Spouse Application: 7th January 2013
Application Refused: 18th March 2013
Appeal Allowed: 29th May 2014
Visa Stamped: 7th August 2014
FLR (M): Applied in Person at Croydon 12th April 2017
BRP Recieved: 18th April 2017

Could i be refused for this?

My husband was refused spouse visa because he overstayed in the uk and the ECO said we'd failed to disclose it.
They also said he was served papers which would mean he could be removed from the UK. Judge said he could not be removed as he volunterily left.
Judge also said yes we failed to write exactly how long my husband had overstayed in the UK but then we had wrote his entry date and his home office reference number. So there was a negative and positive.
He told the home office rep that he believed my marriage is genuine.
My husband was previously engaged to someone else which the home office rep says he must of married
Judge didnt believe that
Home office said my husbands english test provider was not approved at the time he took his test even though i have proof it is approved at the moment. My barrister showed that when we applied they had a license number and its the same license number now.

Home office rep tried to bring up my finance something i was not refused for in the application. Judge told her the ECO was satisfied with my income so it should not be raised.
She told the judge that i had admitted to not submitting a seperate letter from my employer confirming pay, job and start date of job.
She said the job contract does not count. Its in the Appendix fm.
Judge said she is right but it should not be raised now as the ECO or the ECM have not raised it
Judge daid he had a grey area on us not disclosing my husbands return date
There was nothing else he said and he didnt ask me questions
Is this a good sign?
Can i be refused for a point made after the refusal date?
