Visa Application based on Child 7 Seven Years Rule

Post by Ditima98 » Tue Feb 25, 2014 12:10 am

Hello People,
Please could people with experience in this area kindly advise on the following questions:

-My kids were born in Pakistan but have been here in the UK just nearly seven years-can they qualify under the seven year rule. We have lived with them, me and my wife all these years legally under student Visa.

-What documents are required by HO to make application based on 7 year rule? I mean what documents do we have to include for the kids and ourselves? Do we have to submit application at the same time or do we have to do it separately starting with kids'?

-And finally, what are fees requirement? Do we have to show maintenance money for three months or nine months?

Your feedback would be greatly appreciated.

Difficult.

In other words, the Secretary of State's policies as set out in the Immigration Rules recognise the significance of a child living in the UK for seven years but do not regard that as a "trump card" requiring also that it would not be reasonable to expect the child to leave the UK. In itself, that latter requirement would entail a consideration of the child's "best interests.

See also, 21. Relevant considerations are likely to include (click).

I think, perhaps personally, that to send a child back to Pakistan would not be in the child's best interest.
