What do you mean? You are not working? If that is the case then it is of course the case that there is no compulsion for the spouse visa holder to work. It merely needs to be the case that it is clear that no Public Funds will be required.

Or are you self-employed?

By the way you don't apply for ILR "when spouse visa runs out". You submit the form SET(M) before the expiry date of the 2-year spouse visa.

Are you earning at least as much as you would get if you were claiming benefit? Are you claiming public funds, eg housing benefit?

douces, you mention Child Benefit, hopefully being claimed by your spouse, but what about Tax Credits? Are they being claimed as well?

And any other benefits, such as Housing Benefit and Council Tax Benefit?

As regards the figures you give, it is impossible to comment without at least knowing how much your housing costs. How much rent, or mortgage payment, is being paid?

Finally, any particular reason why you are just working part-time?

yes john no tax credit or housing or income support i am seeking full time work at the moment job is hard to find i live with my mom i paid Â£150 toward the rent me and my wife is on her tenancy agreement so as the council tax bill

Why are you and your wife not claiming Tax Credits? They are there to help low-income families like you. You say in another topic that your wife is British, so no problem the two of you making a joint claim for Tax Credits.

Housing costs are Â£150 per month, you tell us, which of course is well below average, and whilst your income is also below average, it looks like you should be OK passing the financial test. But increasing family income ... claiming the Tax Credits due to you ... will of course help.

Based upon the information you have posted, not claiming benefits to which you are legally entitled is more likely to harm the visa application.

You and your spouse should claim Tax Credits immediately. Given that fresh claims can only be backdated for a maximum of 3 months, I dread to think how much money you have lost through failing to claim, especially failing to claim when the baby was born.

Tax Credits claims ... couple living together ... the claim must be made jointly by the two of you. It would be very wrong if only one of you were to claim the Tax Credits.

Compared to ... Child Benefit .... that is a single-claimant benefit ... and your British spouse is perfectly entitled to claim Child Benefit ... but you with your visa condition are not.
