ILR PEO appointment when dependant visa refused previously!!

ILR PEO appointment when dependant visa refused previously!!

Hi All

I am applying for ILR (Tier 1G) at a PEO next week and just read somewhere that a person can't use the premium service if : quoted - "someone who’s been refused a visa in the past"

I am applying as a main applicant and my wife as dependant. The issue is my wife was rejected dependant visa initially after our marriage with the reason given as unable to prove that marriage genuine (something on this ground) in spite of providing 6 months phone record (Vonage) before marriage, marriage certificate, 2-3 photos, passport in new name, affidavit on stamp paper confirming change in name of wife following marriage.

Instead of appealing, I re-applied with more proof - invitation card, marriage photo album, CD etc and the visa was approved.

My questions are:
1. In the above scenario where my wife was refused visa initially but myself being the main applicant, can we both apply using premium service?
2. If no to above question. Is it possible to reschedule my PEO appointment which is currently for both of us and rebook only in my name? And subsequently apply by post for wife's ILR

Any advice from expert would be helpful

I think you shouldn't have any problems with PEO. Just go for it and the best of luck.
Your wife was eventually given her dependent visa when she satisfied the conditions, so should have no bearings on peo.

The question is not about getting ILR but about In person appointment. I came across this new UKBA website which is about applying in person.

You can’t apply in person at a premium service centre if you’re:

* someone who’s been given discretionary leave to remain or humanitarian protection
* someone who’s been refused a visa in the past
* applying to settle on the basis of long residence
