We had our checking service appointment on the 26/01/2016 and they held our application until 01/02/2016 because of the three year rule. This is something I didn't know about! So am sharing for others like me. You must be physically present in the country three years to the day of your application. We were on holiday three years ago at this time so they had to hold the application until after the date we returned.

I entered the country illegally in August2008 and applied for asylum the next day. I was granted refugee status in june 2009 without going to court.
