Has anyone else **submitted an ILR application while dependents were abroad** and booked biometrics later?

Post by geralt » Tue Jun 17, 2025 9:37 pm

**Question for the Forum:**
Has anyone else **submitted an ILR application while dependents were abroad** and booked biometrics later? Any issues with this approach?

### **Key Notes:**
✅ ILR applied under the **5-year route**

### **Immigration History:**
ILR & Naturalization Timeline (Tier 2 ICT → Tier 2 General → Skilled Worker Visa)

🔹 Visa History:
- August 2014: Entered the UK with family on **Tier 2 ICT visa**.
- November 2019: Switched to **Tier 2 General visa**.
- 2022: Upgraded to **Skilled Worker visa**.
- June 2024: Applied for **ILR** for all 3 family members.

🔹 **Current Situation:**
- **Wife and daughter** are travelling to their home country and will return in the **first week of September 2024**.
- **Plan**: Create their ILR applications in the **first week of August 2024** but schedule their **biometric appointments for after their return** (first week of September).

🔹 **Next Steps:**
- Eligible to apply for **British citizenship (naturalization)** in **2025** (1 year after ILR approval).

You should not submit a settlement application while abroad, as such an application would be invalid (except for the routes that allow an ILE application):
Applications for entry clearance must be made when the applicant is outside the UK and applications for permission to stay must be made when the applicant is in the UK. Settlement applications must generally be made when the applicant is in the UK, but it depends on the route.

Your dependents are also required to list absences in the form. You cannot do this if they are abroad as you cannot put a future date of return in the form.

Apply when they are back in the uk.
