Hi,

I need advice it is very urgent. I have BRP permanenet residence card. I changed my passpprt and it is different name to my BRP card and i want it to be same as it appears on my passport. Can I use the premium one day service ?????

I received a refusal later today and the reason is my response is my brother and he's EEA and I'm none EEA nationality the reason they refuse is last 5 years I'm not independent with my sponsor and we don't live together that's the only reason they refusing my application AI don't know what to do now I was working last 5 years and student and me and my sponsor we can't live together as my sponsor is married and got 6 childrens and he's house is 3 bedrooms it's to small for them but I also included my application my sponsor ID and his last 5 years proof work bills everything.
Please is there anyone who can give me best advice what to do now. I really need help the Home office they only give me 14 days to appeal to the decision or make new application. Please give me your best advice.

You have come back with another ID now. One was sharmk I remember. Same old story, your BRP has your fathers name as middle name and passport doesnt.
Well nobody here knows the answer to your question. Do you even know the procedure to change the name? NOBODY here does know these details but you incessantly keep asking questions. Your question should be directed to HO> Call the number and only they will be able to tell you.

Your explanation is very confusing. You first say " I'm not independent with my sponsor and we don't live together". How would you be independent and live with your brother?

You will have to check if you are eligible to apply independently. I think HO has decided that you are not eligible as a family member. This is very complex and the best is to ask an immigration specialist. This forum is frequented by people who are struggling for information. Unless you know what category you fall under, it will be difficult for anyybody her to help you.

just updating here as I checked online just now and it says DECIDED :shock: . After I got the CoA letter I stopped checking online and reading forums, so the waiting wouldn't feel that long. And just by curiosity today I checked it, not even expecting anything as it was always saying "case id not recognised" and BAM! got a DECIDED status. It would be better if I hadn't checked lolol now the next 7 days will be full of anxiety :( but I'm trying to be positive! :mrgreen:

Online pplications for 2 eea nationals and 1 non-eea national (married couple and child)

applications sent: 06/05/2017
Payment taken: 06/05/2017
Confirmations of online applications received: 08/05/2017
Supporting documents posted: 09/05/2017

Applications for permanent residence status

The settled status application scheme for EU citizens will be separate from the current one for documents confirming EU permanent residence status. Permanent residence status is linked to the UK’s membership of the EU and so will no longer be valid after we leave. If you already have a certificate of permanent residence, you will still need to apply for the new settled status document. We will aim to make sure the process is as streamlined as possible for all applicants.

@Abdihakim sorry about your news.
I am in similar situation as you mentioned... BUT....when you lived apart from your brother did all your letters carry your brothers address though you were not living there? E.g. pay slips HMRC coding notice, mobile phone bills, voters card, etc

Hello guys,
I would to ask questions, actually I applied for perment residents card and I receive mail confirmation with my casex ID number so now executive officer mail me and she said refused my application form because insufficient evidence but I asked which evidence do you want to support my application she didn't respond to what i asked by the way I would appeal when I receive all my documents back and I would to know i need to pay £65 again or just free
Please let know any ideas

Your post is unclear. It is a language problem so if you want someone to respond you should be clear and precise. First I have never heard of Case ID being sent by mail. It is always sent by email. Second when you get your refusal letter they will not say two words "insufficient evidence". It will have a whole paragraph explaining what is missing. Evidence of residing 5 years may be missing or gaps in employment history may be missing. How do you expect people to respond when you are not giving details?
If you have read the letter it will inform you that only 1% of appeals are upheld so consider that. It may be easier to reapply. That is your choice of course.
Do you think HO case workers are meant to respond to individual questions? Of coursethey will ignore you. When they send you a letter they explain everything. You should read the guidance booklet and see what documents are to be submitted.

Thanks for replying sorry about writing email like this way it's a mistake by the way I send all my documents the only thing I didn't send was my Bank a statement and I asked them if they want my Bank a statement as proof of been in UK for more then 5 years contusions period with out break, that's mean i never been outility of UK since I enter to Uk and it was the end of 2010, I waiting all this time and the end they refused it's frustrating .

As you said I need to check guidance it's show me permanent resident card under EEA regulations.
You must normally have live in the UK for a continuous period of 5 years as
An EEA National qualified person as (worker- self employe- students- self sufficient -jobseekers)

It's simple all my documents shows I have been as student, jobseekers and worker
The other thing before I send my application form it's went to citizen adviser and he told me every thing ok with my documents and I am able to apply for perment residents card.

You should have sent bank statements. Did you have CSI (comprehensive sickness insurance) or a non UK EHIC card for the whole time you were a student?

I didn't send my Bank statement i thought the document I send it's enough as proof and I told them if they want me to send all my bank statement i can post it by royal mail first class but they just want get my money without any a big reason for refusing but I will take further and appeal for the decision .

You have not clarified the reason for refusal. Insufficient evidence of 5 years stay in UK?
or insufficent evidence of being a qualified person? Or as Casa stated did u provide CSI evidence?
Citizens advisory is not really reliable. They can guide you but they are manned by volunteers who dont really know much about the operations of HO. I too went to Citizens Advisory and the person there was only saying send as much documentation as you can. If you send everything you have you cant go wrong. There are so many people asking them for advice that they dont give you more than a few minutes of their time.

Your attitude does show you think you are smarter than HO case workers.
First the case worker is not interested in your money. They are not working on a commission basis.
You dont know the actual reason for your refusal and yet you behave like you have a right to your PR. Doesnt work like that my friend.
If you want help here you should help yourself first. Read carefully the reason you have been refused and if possible type the entire paragraph. Then someone may be able to help. You have concluded with your bad English that it is because you have not provided Bank statements. It may not be the reason. Get someone who speaks fluent English to read it for you. You already think that because you sent a lot of documents proving you were a student, worker, jobseeker you should be given PR. According to HO you may not be a qualified person exercising treaty rights. Find out and then come back here.

You are complaining about £65. The UK visa route PR that non-EU migrants have to pay for costs £2,287. Life isn't fair!

If you expect any advice on the forum, you should post what has been asked for. Just living in the UK is not sufficient to get PR, you must have been a qualified person exercising treaty rights for the whole 5 years.

That's what I want treat fairly not just fooling you , I am 100% qualified person and I have been living in UK more then 5 years there's no cap between 5 years ,I know is £65 but I work hard for this money and they take it from you because silly reason I'm not taking it and I will do anyything to get what I want .

So why don't you simply :

1. Post the refusal paragraph for us to read.

2. Answer my question about CSI when you were a student.

3. List the documents that you sent.

You won't get your money back, so no point even trying. If you failed to meet the requirements, then you won't be issued with PR.
