Hi guys! i think i gave the wrong info,i said in my other topic that i came into the uk under MARRIAGE VISA which actually a VISA MARRIAGE..now i am confused again if i am eligible to apply for ILR set (m) i came here in the uk under VISA MARRIAGE with my husband's name next to it on 10/05/2012 got married 19/06/2012 apply for FLR(M) on august as we have to wait 28 days before my visa expires 13/09/12,they granted me a spouse visa on 19/03/13 till 19/03/15..the letter i got from UKBA along with my biometric said that i can apply for ILR set(m)after 2 years of living here in uk as a spouse,my question can i really apply for ILR despite that we apply for FLR after 9th of july 2012? are their attached letter with biometric permit can prove it?i am not claiming any benefit,stay here in the country since i arrive and happily living with my english husband and our daughter together,pls any reply to clear my mind as this is really confusing me,i should have to think about my pregnancy but this visa issue is giving me headache!any reply please,thank you!

thanks for your reply,so VISA MARRIAGE and MARRIAGE VISA are the same?even it's just a UK ENTRY CLEARANCE to come here on 19/05/2012?that means i qualified for ILR even though we applied for a spouse visa on august 2012?sorry :oops:

thank you vinny!i read that link again and i understand now that i was granted a UK entry clearance to come into the uk under visa marriage before july 9,2012 so i am in the old rules! that's a relief,have to think now of LIUK test..thank you!

Hi everyone,i am on a spouse visa at the moment and applying for ILR on march 2015 and one of the requirements is to pass the LIUK and B1..the letter that i got from UKBA says that i can apply for SET(M) after 2 years as a spouse in the UK and it's either i have to pass the LIUK test or improved by one level by gaining an approved English for Speakers of Other Languages (ESOL)qualification which includes citizenship material..i am reading the LIUK book and practicing test online but i don't know if in the actual test is more tricky than the free online test and what if i fail coz it looks hard for me passing the LIUK test..does that mean i can take ESOL with citizenship as an option in case i failed the LIUK test?thank you!

You're reading out of date information. You now need to pass the Life in the UK test and have B1 level English for ILR

i thought if english is not your first language and my english of level is below you don't need to pass the life in the uk test and why ESOL with citizenship still exist?thanks for the reply!

The ESOL option as an alternative to Life in the UK has been withdrawn. Don't forget you also need to pass a B1 level English test.

A person must meet the requirement by:
passing the Life in the UK test
and either:
having a speaking and listening qualification in English at B1 level or above of the
Common European Framework of Reference for Languages (CEFR)

 having a degree that was taught in English, or
 being a national of an English-speaking country

i read in UKBA website that you need to pass both LIUK test and B1,i still have my IELTS certificate with a scoreband of 5 but was taken last november 2011,listening was 4.5 and speaking 5.5 and correct me if i'm wrong coz it says there that they still accept it even it's expired as i used it for entry clearance..are they gonna send me home if i failed the LIUK test?i know i can retake it but the questions looked really tricky,i'm trying my best to study but it's all in one go as i'm looking after my 16 month old daughter plus i am 23 weeks pregnant and still waiting for my passport to change under my married name,whew! thank you casa!

No they won't send you home. If you're not able to pass the Life in the UK test before your current visa expires you can apply for FLR(M) with your ILETS (which will give you a 2 year extension) and then apply for ILR as soon as you pass. i.e without waiting for the 2 year extension to expire.

so they will still accept it? i just keep browsing in different websites about what if i fail in the life in uk test and what i understand is if u failed the liuk test and your spouse visa is expiring soon you can extend under FLR(M) but you have to take A1 test first ormaybe i'm wrong..anyway casa thank you very much for your time and for helping me to breath a li'l bit as LIUK test is pressuring me big time..God bless!

i'm trying to read the official handbook during daytime when my daughter's asleep,but it's not more on reading as you have to understand it as well so it hurts my eyes and have headache,when i received the book it upsets me to be honest coz it seems like i am going to build a business here or i'm gonna work as a doctor but it's one of the requirements so have to take it whether i like it or not,sorry casa i talk too much!do u mean a handbook (audio)?haven't tried it yet,maybe it's more clear when i'm listening than reading. :oops:

If you feel it would help, during the test you can choose the listen to the questions through headphones while reading from the screen.

Hi does anyone knows what options do i have if i failed in life in the uk test? i am applying for ILR on march 2015 and i just got my new passport under my husband's name,just asking coz i'm worried if i failed as i can't concentrate and i am more focus in my pregnancy and looking after my toddler plus the questions are tricky,is that ESOL with citizenship not available anymore?thank you!

You can try and write the test until you pass. You can write the test as many times as you wish till you pass and can also ask to listen to the questions while look at the screen. Alternatively, apply for an extension of your existing visa (which you don't mention what it is) and then apply for ILR when you do pass the test.

Bear in mind you will also have to pass B1 level English, unless your nationality is on the exempt list as English speaking.

thank you for the reply,i am on spouse visa at the moment that was granted last march 19,2013,i arrived here in the uk under marriage visa on may 10,2012..i also wanna ask something but my husband is worried if it will affect my application for ILR,he is an english citizen born and raised here,both parents are too plus great grandparents,he wanna claim bebefits but just worried that it will affect me,at the moment he's claiming child benefit which is he entitled to but apart from that nothing else,what worries me more is their company is getting rid some of the employees and making redundant and that's bothering him,what if he'll be out of work this january?will they refuse my application?what sort of benefits can he claim that won't affect me as i am feel so sorry about him,don't wanna leave him alone with our 2 kids,can't swap them for the world,sorry just carried away,thank you!

For a spouse visa the English requirement is A1 and for ILR it is level B1, so you need to check you have the correct level.

Your husband can claim benefits he is entitled to. If he claims working/child tax credit, it needs to be claimed in joint names. T

ILR due on March

Hello i am applying for ILR on March 19 and have to apply 28 days before so that means i have to send it by post on Feb 20 isn't it?and does anyone knows that apart from LIUK test what sort of english requirement does UKBA needs?i have IELTS with me but got no time to get LIUK test as focusing more on my pregnancy and going to have second baby on wednesday january 7th via c-section,want to try to take an exam after giving birth but worry that i will fail and so close now for applying ILR,can anyone help me please..thank you!

thank you vinny,just a little bit confused though coz my IELTS certificate is acceptable as that what's i used to apply for further leave to remain before(spouse visa),i got a scoreband of 5 and the letter from HO says that i just need to improve my scoreband by one level by taking ESOL with citizenship material or take a LIUK test but i've heard that they changed the rules and can't take ESOL anymore so just asking if i can sit for an exam that is acceptable by HO apart from LIUK test as questions as well is bit tricky,lucky if you have the easy questions...thank you!
