Hi Atikur,

To the best of my understanding, You can withdraw an appeal anytime. Doing so will however make you an over stayer. You can under no circumstances apply during the 14 day appeal period, that's for sure.

The way it is generally done is, you send in a letter for with drawl of appeal to the court. In 2 to 3 days the court sends in a confirmation of with drawl at your correspondence address. Together with your withdrawal letter you receive from the court and your SET(LR) file you could then go for premium appointment.

Need to ask you two things as follows,

Guys,my case brief:
28/11/2005- Entered in the UK as student
Student until 2012 and then 2years in PSW
11/09/2015 Applied for FLR(FP)..got refused on 11/12/2015 with appeal right.
05/08/2015 First Tier Tribunal Hearing
Based on the aboove scenario do you guys think that to ab eligible to apply for ILR would be easy enoyugh for me..and also
1.Can I apply 28days earlier as one of the Solic said this is only applied who has valid visa.
2. Can I count 56 days extra time toward my ILR (28Days over stay period+ 28days early application).
Plz someone adviseme.

As you stated above, you got refused on 11/12/2015, that date is in future. May I ask how did you get refused in future. If you are really very serious about not getting your ILR destroyed and are seeking Free of Cost EXPERT opinion, then the least you should attempt for is to make sure you state your case clearly. I know you keep stating in your previous posts "That was stupid mistake". Strictly speaking you are not in a position of making stupid mistakes every now and then. You are betting on people to make a sense of your mistakes automatically, which is dangerous. Don't place a bet you can't afford to loose.

Secondly can you please share your time line for FLR - FP application,

1) Date you applied for FLR- FP (Please state correct date)
2) Date you received your refusal with right of appeal for FLR - FP (Please state correct date)

JaguarXF thanks for your replay again. I really dont understand your point about betting things. anyway, I am a human being and to err is human. I even tried to correct the date but couldn't find the option of editing.
my correct date will be as follows

FLR FP Application Date: 11/09/2014
Refusal letter with right of appeal received on: 16/12/2014

My friend,

By betting what I mean to say is, trying to gamble in between the opinions you get from different sources from different lawyers etc. You need to stick to an opinion which would seem solid enough to pursue your case. I have seen from previous posts at your thread that haris_zam, and Zaiddi have already provided solid enough opinions based on experiences other members have gone through.

You don't have much time. Strictly speaking you need a
reliable
immigration solicitor one who would not drag your case just to make more money. It would be worth your time and effort looking for a good immigration solicitor,even if that would mean travelling long distances.

I thank you for providing with your FLR - FP time line. Congratulations on clocking in your 10 Years today on Saturday the 28th of November 2015.

It isn't for "nothing". There is a distinct advantage, because if you put in the 10 year application within the 28 period that doesn't count as overstaying, and there is ANY PROBLEM AT ALL, there is no right of appeal, nothing. That's it, end of. So although you might think it's over-cautious, it's most certainly not a complete waste.

Did anyone apply for SET (LR) by post after completing 10 years without withdrawing their case from first/upper tier tribunal? If I do so what could be the consequences?

The reason for doing so is to continue my legal work right?

Attended PEO appointment at Liverpool on 7th December 2015 at 10am. Bio done at 10.20am and 11.30 came out with acknowledgement letter.
Guy said, he couldn't make any decision without my passport and therefore he asked for the passport and LIUK test certificate to the relevant department.

I watched him checking my documents and also in computer screen from the waiting area. he spent almost one hour with my files and finally put them all in a folder and kept in the shelf behind him and called me to hand over the acknowledgement letter.
he also mentioned that he doesn't need further check as he already completed everything. he just need my passport and LIUK to make the decision. he said by the end of this week i will receive them (he also asked me which address i prefer for the documents to be sent).

Great to hear from you again. Thanks for the update. By the looks of it you seem to be getting your ILR acknowledgement letter in 15 to 21 calendar days time. Hopefully you will receive a positive response over the next three weeks time by 21st of December 2015.

My final and hopefully last update of my case:

I have received DX's failure to deliver letter on 19/12/15, but unfortunately the letter has come across to me this morning which is 21/12/15. Then I called to them to arrange a collection. But they said I have to contact to home office to get it redelivered..any way, cut the long story short..I have got hold of my BRP today. HAPPY NOW.
