ILR refused for applying early - advise needed.

posted on another chat but hoping for some more advice. i've had the same issue with applying too early, by 2 months. put the date of arrival in march and didnt realise the fiance visa didnt count. i dont know why my visa was just totally refused instead of offering the 30 month LLR

my spouse visa expires 21 June and my 5 years would be 01 July. So can i even reapply if my visa is expired?

is there a way to get refund for the difference between the amount of a SET (M) visa application 3,300 and a LLR which cost 1,033 + 1,000 for the health surcharge? 1,000 back would be nice seeing i will have to reapply in the future
