Urgent Please Answer - ILR SET O Form - Question

Post by lucky1234 » Tue Apr 10, 2012 9:29 pm

Hi,

I have PEO appointment next week and have following question about the form.

Q1. 6.1 When did you (the main applicant) first enter the UK? This
refers to the date of your first entry into the UK at the beginning of
the period of stay on which this application is based.

1- came as student in Sept 2005.
2- 4 Nov 2006 WP1 approved
3- 20 Nov 2006 FLR approved (PEO)
4- Eligible to apply ILR 20 Nov 2011.
5- PEO appointment 19April 2012 (Claiming 5 years period 20April 2007 - 19April 2012)

What would be the answer to above question? My perception is either 20Nov 2006 or 20April 2007. I will appreciate your quick response. I don't think that it will be a date when i first arrived in the UK isn't it?

I think it should be 20Nov 2006.

Thanks very much to both of you.

Have you experienced it yourself or something from you knowledge base?

Secondly i am bit confused between 20Nov 2006 & 20April 2007. Since five years period back from 19April 2012 ends on 20 April 2007 why should i put 20Nov 2006? because next question says

"6.2 Since then have you had any absences from the UK? If yes, give the dates you left and returned to the UK and the reason for the absence in the spaces below. List allabsences however short and in date order. If you need more space, continue on a separate sheet and enclose it with your application"

IF i give 20Nov 2006, my total absences from UK will be more than what it should be with 20April 2007. Although they will still remain under threshold of 180 Days in 5 years but still.

Any comments are much appreciated??

lucky1234: as nnj10 suggested, it would be 20-Nov-2006.

Basically if you were already in UK, you need to put the date you switched to a category (WP in your case) which leads to settlement.

thanks linkers.

Lets say if i write down 20Nov 2006 then from 20Nov until now, it is about 5 years and 5months and in question 6.2, i have to list down all the absences which will be more than if i claim from april 2007.

April 2007 - April 2012 = 5 years (133 holidays)
Nov 2006 - April 2012 = 5 years 5 months (150 holidays)

What should i do to provide precise answer to question 6.2? because i will claim ilr for last 5 years not 5 years & 5 months?

I will appreciate your advice

Cheers

You need to provide absences in last 5 years.
