Tier 1 General to Tier 2 dependant

Post by feedback556 » Wed Apr 11, 2012 10:17 pm

Hi

My spouse is planning to move from Tier 1 general to Tier 2 defendant (due to shortage of earnings for Tier 1 extension) and I would like to know if he can apply for this switching from within the UK or will need to go to home country for the application.

Apologies, if I am restarting something which has already been posted however, I spent a good time looking for such scenario on this forum bit could not find one.

Appreciate the experts' opinions and suggestions.

THanks

switching from within the UK is not possible as 319C(h) is not satisfied

He would need to apply for entry clearance from outside the UK.

Thanks for the confirmation Greenie.A couple of more quick questions in this context...
1) Is it necessary for the dependant to apply with me for his switching or he can apply later as well when his tier 1 is about to finish?

2)We are expecting a baby also and if I am on tier 2 then and he is on Tier 1 then, would I be able to get the Tier 2 dependant for baby separately or how does that work?

Appreciate your patience and help.Thanks.
