Tier 1 dependent

I have couple of question for all the experts on the forum.

1) Can a tier 4 student (entry clearence in december 2010) switch into tier 1 dependent visa(as a wife) from within the UK or will they have to go back to their own country?

2) If they have poor attendence record on the course they are on, will that affect their application for tier 1 dependent?

1) Must apply outside the UK
2) Define poor attendance? If she has breached the conditions of their Tier 4 leave they may be refused entry as a PBS dependant. The refusal will be on general grounds.

Thanks for the prompt reply. I think she will be refused on general grounds as she has not been to college for past year.

Yes she has been workin all this time. However I am not sure if this has been disclosed to the home office.

When she applies she is obliged to give her NI number.

6.1 If you have a UK National Insurance Number what is the number? >

She does not necessarily have to make statements about her previous circumstances if not actually requested to do so in the application form but she does have to answer any questions that are asked in an honest and truthful manner. Don't be tempted to lie in any answer. Tell her to heed this and then all she can do is wait and see what happens.
