TIER 1 GEN EXTENSION

Hello there
I got my HSMP visa in Jan 2007 (initial entry clearance application got approved in Sep 2006) but came to the UK only by mid-Oct 2007, spent 2 weeks here attending various job interviews and went back to India by end-Oct 2007.

Then I came again to the UK in June 2008 (7-months break already). From June 2008 onwards, I am staying here without any break.

Then, in Jan 2009, my HSMP visa went for a renewal (2-year completion) and I got a Tier1(Gen) stamping from the UKBA which is valid till mid-Oct 2012, which will theoretically take me towards a settlement application this year.

Since there is a shorfall of 7 months due to personal medical reasons, do you think I will still be able to apply for ILR in Oct 2012. If not, should I apply for an FLR? If it is FLR, is it FLR Tier 1 (HSMP) or Tier 1 (Gen) extension?

Please advise.

Your five year residence period was reset in June 2008. You will be eligible for ILR in May 2013.
