FLR M Or Not?

FLR M Or Not?

Hi all, I really tried to look into old threads but none couldnt answer my specific question. Can you please help me with my question? Please.

I got my ILR today 16.04.2012. My wife has a dependant visa (Tier 1 General) valid until 12.05.2012. She was granted this dependant visa for 1.5 years (less than 2 years required for ILR dependant).

Currently she is in India. I understand that if she was in the UK now, I had to apply for FLR M to extend the stay to meet the required minimum 2 years before I can apply for ILR for my wife.

As she is in India currently she has to apply for extension through Indian UK consulate, however, I am not sure if the same FLR (M) application can be used from India? or is there any other application form that she should use?

Please help me..

She can't extend her current leave in India and she would have to apply for a spouse settlement visa. If she applies for a spouse visa in India she can' t take advantage of para 287 (a)(i)(d) and will be obliged to make 2 years on that status before ILR. If she applies for FLR(M) inside the UK she can apply for ILR within six months (assuming she entered the UK 1.5 years ago).

It would be better to return to the UK and apply there but there may be issues with her entry if they know that you already have ILR..........but whatever she applies for she will need to have passed an approved English exam.

Thank you very much indeed for your help. If applying from India for spouse settlement visa which application form she should use and whether she need to sit for life in the uk test still? She has a English taught degree and a Uk naric letter to confirm this too. Thanks in advance.

Ah Ok! Not sure what to do next really.. VFS India are not capable of answering such queries too.
