Documents (Contractor) for Tier-1 (General) Extension

Post by rtammana81 » Wed Apr 18, 2012 1:52 pm

Hi,

Could someone please help me for the list of documents required for my Tier-1 (General) extension. My current situation is - I am a contractor working for UK Telecoms company. I have setup my own limited company and I am the sole director (100% share) of that company. I am currently drawing salary as well as dividends from the company since Aug'11. However, I have drawn dividends only for 5 months and not for the entire period since Aug'11.

Now, could someone please let me know what documents do I need to produce to HO given my case above. Could you also please clarify on the following points:

1. Will I be classified as a salaried employee and not self employed?
2. Do I need to produce any company related documents like:- Business bank statements, PAYE/NIC payment receipts, VAT payment receipts etc etc
3. My accountant will provide me a letter confirming that I am the sole director of the company and its incorporation details along side my drawings (salary & dividends) to date. Do I need to request my accountant to include any more details other than the above?

As of now I am planning to produce - Payslips, Dividend vouchers, Personal bank statments, letter from my bank confirming that the maintenance funds were held in the account for atleast 90 consecutive days, a letter from my accountant confirming my details.

I would really appreciate if someone could help me on this.

Thanks a lot in advance.

Best Regards

You declare/draw dividends, its all your discretion. Hence, do not worry.

Employed as your drawing a salary. Applying as self employed requires lot more documents.

2. Do I need to produce any company related documents like:- Business bank statements, PAYE/NIC payment receipts, VAT payment receipts etc etc

I would add business account statements, all the proof related to you paying taxes (e.g. P60, your account should help you with this). If you are paying yourself a salary then proof you have paid Tax and NIC - ask accountant. Though invoices are not required, they are required when you apply as self employed, I will still include them.

I would really appreciate if someone could help me on this.

Thanks a lot in advance.

Dear Rajesh,

Thanks a lot for swift response. Much appreciated.

Regarding invoices, I have self bill Invoice/Remittance which are raised by the agency and sent to me every week. Is it ok to submit these towards invoices as you suggested?

I am planning to go for the interview sometime in May'12. Can I request my accountant for P60 for the period ending 05/04/2012?

Thanks a lot once again.

Specifically regarding ....
Can I request my accountant for P60 for the period ending 05/04/2012?
Assuming your company is also set up as an Employer (for PAYE/NI) with HMRC then the company has until May 19th to file the Employer Annual Returns:

http://www.hmrc.gov.uk/paye/payroll/yea ... return.htm

The P60 is the counterfoil for the P14; employees are legally entitled to receive a P60 assuming they are still an employee on April 5th.

I'm assuming that your accountant is taking care of all this for you so s/he will be providing this for you within the next month. If you are unsure then do check with them as the responsibility ultimately falls on you as director to file them with HMRC.
Please don't private message me or e-mail me for free personal advice - you are just wasting your time writing something that won't get answered.

Amount transfered from business account to personal account

Post by Jayaprakash28 » Sat Jun 30, 2012 12:56 am

Hi Mathew,

I appreciate your valuable openion for my visa extns. I am employee of my own limited company. My accountant generated Dividend + salary everymonth and advises me with Remittance advise to transfer the amount.
Issues:
1. I have done that to my personal account, however the amount includes salary + dividend. Does this creates any problem.
2. One more issue is i have transfered the same amount in 2 transactions. Does this creaed problem for claiming the amount as earnings and matching with bank statement.
3. with ignorance half knowledge, i have mentioned the payment description as 'Loan' for one of transaction, however the amount is relflected in Dividend and accountant has certified that as dividend. Is it a problem.

Thanks a lot for your help.

Rgds,
Jaya
