Naturalization residential criteria

Post by I-L-R-2011 » Wed Apr 18, 2012 2:47 pm

Hi Guru's

I have question regarding the naturalization residential criteria, where it says, one should have been physically present in uk prior to 5years when appling for naturalization.

for example: if I apply on 18/01/2013 then I should have been physically present on 19/01/2008.

I wanted to apply for naturalization along with my wife and son. But the situation is, my wife was on maternity leave and went back home(india) from 27/11/2007 to 15/05/2008.

Me and my wife time lines for 5 year residential period are:

Me
Arrived in UK :20/09/2006
HSMP
ILR on 19/01/2012

my wife
Arrived in uk :10/11/2006
HSMP dependent
maternity leave : 27/11/2007 to 15/05/2008 (traveled to india)
ILR on 19/01/2012

with the above situtaion can my wife apply along with me on 18/01/2013 or she needs to wait till 16/05/2013 as she was absent from UK for that 5 year prior start date criteria?

your help would be much appreciated.

Thanks,

vinny

Safer to wait, unless she's applying as a spouse of a British citizen.
