Tier4 Limit of five years

Ok
these new rules are confusing me :roll:
I came in UK in sep 06. than I extend my student visa in Jan 2010
from March 2011 I am on PSW. I have 6 month foundation followed by 3 years Bachelors.. and one year diploma which i have done in 06/07

Can I spend any more time as student as my over all time is 4.5 years as student but on tier 4 only 14 months.
Please urgent help needed

You cannot spend more than 5 years as student but your time will be extended if you apply for Master degree after PSW finishes.

Read the new Tier-4 guidance carefully from UKBA website.

This 5 year limit at degree level is not applicable to those who applied before 6th april 2012.Am I right or wrong?

As far as i have heard, its counting from March 2009 .

But if some one can clear that student visa obtained before 2009 which was not in tier 4 will count towards 5 years?

according to the rules, both tier 4 leave and student leave prior to march 2009 will count towards the limit.

(ha) If the course is at degree level or above, the grant of leave to remain the applicant is seeking must not lead to the applicant having spent more than 5 years in the UK as a Tier 4 (General) Migrant, or as a Student, studying courses at degree level or above unless

In my opinion, this change is retrospective. All student visas and student leave to remain will count towards this limit.

There are some exceptions according to new Tier 4 regulations which are detailed in Tier-4 guidance.

In your knowledge can I go for master? As i have spend three years on degree rest was below degree level
