Working tax credits - Spouse visa query

Post by NMck » Thu Apr 19, 2012 3:37 am

I have a quick question, perhaps someone can help me with.

I recently applied for working tax credits. I will get my first payment on May 1st and the sum is not large at all.

I plan to get married in June therefore the payments will most likely stop anyway. My partner will be applying for a spouse visa after we marry in June to move to the uk from Venezuela and I wanted to know if my tax credits will affect this and should I just cancel them now? The first payment hasn't gone in and I won't really miss the money.

Any advice would be greatly appreciated.

The fact that some of your income is Tax Credits is not an issue as such. However there is still the matter of passing the financial test, to show that the applicant will not need to claim Public Funds as defined.

In order to get Working Tax Credit your income, by definition, is on the low side, so you need to do the calculations carefully to show that the financial test is passed.

Thank you for your input.

Can I ask, if anyone knows how the financial test is conducted? What do they consider "enough" money to support a spouse?

I know I will have no problem supporting my partner. I live at home and pay no rent which I will continue to do with my partner and I earn enough money to support both of our living expenses.

Any input would be appreciated. Thank you.

The current level for a couple is £105.95 weekly remaining after rent or mortgage, council tax and any credit/loans have been paid. Bear in mind that this is under current regulations which are due for reform later this year.
If your parents own the property you will need a copy of the mortgage agreement, or a copy of the deeds if they own this outright. If they are renting, you should submit a letter from the landlord agreeing to you and your husband living there. You also need a letter from your parents confirming the accommodation will be available rent-free and proof that it will be of sufficient size to accommodate you both without overcrowding.

Thank you so much for this feedback.

I am well within the range for a couple so a huge weight has been lifted off my shoulders.

As far as proving the size of the house, I can take photos. Will that be enough or will they need dimensions taken by a surveyor? Perhaps this is outlined on the deeds to the house. I am getting these this week. Although, it is a 3 bedroom house and there will just be my mother and father, me and my partner living there.

Literally, grab a tape measure, and ignoring any Spam, bathroom or toilet, whatever their size, how many rooms in the place exceed 50 sq. ft in size?

Also, assuming the visa is granted, how many adults will be living there, and how many children, and as regards children, their ages?

I will get my dad to measure the rooms later.

There will be no children. Just my mother and father, me and my partner.
