All (particularly the gurus),


I'm due for ILR by end of October 2012 via Tier 2 route (ie: Work permit from Nov 2007-2009, then transferred to T2 under transitional arrangements).

At the time of my Tier 2 application in 2009, my job title (Geoenvironmental Engineer) which was (and still is) under shortgae occupation came under Standard Occupation Code SOC 2121 (Civil Engineers). But, following the most recent MAC review on shortage occupations, the same job title has now been moved to SOC 2129 (Engineering jobs not elsewhere classified).

Now here is the probem,

If my job title was to remain under SOC 2121, I would be well above the going rate required for ILR. But under SOC 2129, this will make my salary to be slightly below the required going rate for the same job title.

I'm confused on what going rate to fulfil by Oct. 2012....

Would it be possible to argue that I am expected to fulfil the going rate under SOC 2121, which was the code that my job title came under at the time of my last leave to remain application in 2009.

Or

Is it simply a case of saying that SOC 2129 will apply.

(Please note that my last LTR was granted following a successful appeal on the same subject matter (going rate))
