Can You Appeal A Refusal For A Flr After A Fiance Visa?

Can You Appeal A Refusal For A Flr After A Fiance Visa?

Just wondering, if after being married and applying for an FLR and they refuse, can it be appealed and if so would my wife have to go back home while awaiting a decision or can she stay here?

She can appeal, but what makes you think that someone who has already been pre-screened for settlement (by virtue of the fiancee visa) is likely to be refused? What can go wrong if you actually marry and otherwise nothing else has changed about your circumstances? Can you elaborate your concerns?

Well my Solictor said "ohh well they can still refuse you a FLR after yuo are maried yuo know!!!" My Solictor was so negative about everything, she also didnt know what English test my Fiance needed to take.

Well the thing is that we are going to stay with friends untill we get married then move into our own place right a couple of days after we are married and then apply for FLR, but the solictor said they will refuse you an FLR as you will be living in a different property to the one that you said you would be living at on the Fiance visa.

So get another solictor; one that works in immigration rather than property conveyance!

You will need to provide the majority of the evidence that you previously provided but if you have moved house you provide those new details. You know the requirements (by now) so just follow the instructions on the application.

Out of interest, would she have to go back if they denied her the flr and we appealed?

I'm not going to speculate on hypothetical situations. In your other thread it's become clear that you don't, in fact, have a fiancee visa yet and will be applying soon. That' very different to the tone of this thread which implies that you have already been issued a fiancee visa. Stop wasting people's time.

I am not wasting peoples time but we have to prepare and think ahead. I need to prepare for the fact that if she does not get the FLR would I be without my wife and she would have to go back home, this would be very emotionally distressing and I need to prepare for all possible outcomes that would be detrimantal to my health and also helps determine how long my lease should be. As I would make it a short one if she is refused a FLR and has to go back home.

Newlight. no disrespect to you, but I have just gone through all of your posts and I have come to the conclusion that you are not here to seek personal advice for yourself are you?.

It appears that you are asking questions for others, because they are so many different questions on different subjects in your posts for me and others to believe they relate to you personally.

If this is the case, then you should stop it as Lucapoka rightly states you are wasting peoples time
