HeLP me to Decide....

I got work permit on 10-06-2007, came to uk on 22-06-2012. I got tier 1 which valid from 12-05-2009 to 12-05-2012.

I have got few difficulties.

1. if ukba consider 22-06-2012 (date of entry) i have got short fall of more than a month from 5 years continuous leave. But 13 days to enter into qualifying period of 28 days.

2. If ukba consider 10-06-2012 starting date (by considering issue date and travel date), according to ukba calculation I would enter into the qualifying period on (28 days) 13-05-2012. They are calculating from 10-06-2012. In that case 10-06-2012 minus 28 days is on 13-05-2012. But my visa expires on 12/05/2012. which is on 4 years 11 months and 3rd day. UKBA call centre agent told me if i want I can take the risk of sending the application for permanent residency rather than extension and I can send it on the last day which is on 12-05-2012. By the time they will receive my application, I will enter into the qualifying period for permanent residency. But it will depends on the case worker. What do u guys think? is the risk too risky? is there anyone who was successful even though applied before 28 days of qualifying period?

You need to correct your dates in your post...there are lot of discrepancies in your dates above
example you have mention "I got work permit on 10-06-2007, came to uk on 22-06-2012"
how can 22-06-2012 be 'came' i.e the past when we are still in the 4th month of the year 2012
Please correct all your dates and post, we may be able to advise better

sorry for making this complicated; i actually came to this country on 22-06-2007.

There is no problem with your case as case worker can use his discretion of 3 months to grant the visa but its totally upto CW to grant this discretion
