Working abroad while having ILR

Post by FunkMaster » Tue Apr 24, 2012 9:41 am

Hello All,

I have a generic question of sorts and have done some searches on the boards here, but perhaps my search terms are not adequate or my question is just out of the ordinary, so thought I'd ask it.

Background

I am currently in the possession of an ILR which I acquired at the end of February 2012.

I have been working for the same company for the past 6 years and plan on continuing my work with them.

Question

However I have just been offered a position to work abroad over in Dubai, for this same company. I am not sure of the logistics, such as:

Would I be paid in the UK, pay UK tax, but just work over in Dubai and the the Middle East on their behalf.

Or would I be transferred to local payroll in the foreign country.

But the question I really have, comes down to the British Passport side of things. As I have about 10 months to complete the additional 1 year over the ILR to start the process of naturalization and the application for a British Passport, something in the back of my mind is suggesting that it would be a risk taking a job offer, be it with the same company, but in another country ... as that would have me out of the country for an extended period of time and may reflect badly on my application for Naturalization and a British Passport.

Would you agree or share any thoughts on this?

You should ask the company offering you the job about how you would be paid and taxed.

As far as a citizenship application is concerned, a key residential requirement is that you were actually in the UK (i.e. not on holiday abroad or something) exactly 5 years (or 3 years if applying as a spouse) before the date of your application.

Assuming you are not applying as a spouse, during the 5 years prior to your application you should not have spent more than 450 days outside the UK, and during the final 12 months of that 5-year period no more than 90 days.

So unless it's a short-term contract in Dubai you would be unlikely to meet the residence requirements if you went to work there.

ILR Holder working in EU

Post by savisrich » Fri May 11, 2012 9:09 pm

Hi there,

I am in a similar scenario as FunkMaster.

I hold the ILR visa and I have an offer to work in the Netherlands.
My concern is with the tax on my income and my status of resident in the UK.

I am not planning to obtain the British Passport but I do intend to keep the ILR Valid.

If I were to work full time in the Netherlands but keep coming back to the UK every 1/2 months.

Would this help me keep the ILR valid?

ANd what will I be taxed?

Would really appreciate your thought/input on this tricky subject.

Many thanks!
