Is it deception?

Post by arash_uk » Tue Apr 24, 2012 3:29 pm

I am now in the UK and I want to extend my Tier 4 visa. I changed my family name (for my own reason) some years ago. In my country, any name change registered in the birth certificate or ID.

When I filled the application form for my initial entry I did not mention the name change (I actually forgot that). On the other hand, there is no explicit question in VAF9 regarding previous name (there is a question about Other Names which I thought it is for the girls who changed their names after marriage). But, I submit my brith certificate and in that it is stated that my name changed.

Now, I want to fill the Tier 4 application form. There is a clear question about any previous name which I am filling it. I'll submit the birth certificate as well. But in a question "have you used deception?" I do not know that if I actually did that???? I did not explain on the application form but I submitted the birth certificate which shows my name change clearly.

Thank you for your comments.

If you legally changed your name and this specific information (asking you had previously been under another name) was not requested on the UK visa application form, then I can't see any deception.

Thank you for your reply. Actually there is a question in VAF9:

2.3 Other names (including any other names you are known by and/or any other names that you have been known by)

which i leave it blank but as i said before I submitted the document which showed my name change.

Then, my question is that if you do not answer a question but you submit a document which shows information relating to that question, is it deception? If I wanted to deceive then why I submitted that document?

Well, that's different. You should have responded to this. It's not deception but an oversight.

Thank you for your email. Then, what should I do now? Explain in a cover letter that I forgot but I submitted the relevant document? Or I just fill the new application form and answer to the question regarding previous names?

Response, not email. I would not wish others to assume I comment in private to posts that appear on this forum.

I'm inclined to say that if it ain't broke, don't fix it. If this matter is raised in any future dealings with the UKBA you can then plead ignorance and show your valid paperwork to indicate that your name change is not something insidious to frustrate the immigration rules. Perhaps others may have another suggestion.
