Spouse's VISA Confusion

Post by Rajeev123 » Tue Apr 24, 2012 3:41 pm

Hi,

My future wife has now decided to do her masters. I am a little confused what VISA she should come in the UK as-
1. She can come as a dependent and do her studies
2. She come here on a student visa.

Kindly suggest what should we do...

Thanks again guys

It's really up to you to decide what suits your purposes. If she comes as Tier 4 migrant she will have to get a CAS and have substantial maintenance. If she comes as a PBS dependant she needs only 600 pounds in maintenance and no CAS.

However, if you lose your leave or can't extend, and she is sponsored by a HEI, you can leave the UK and return as her dependant.

There is much to consider.

Kindly help me with few questions below ( I know you guys are the beset lot)

1. I am planning to get married on 28th June 2012 and my future wife will be applying for a dependent Visa. Now I have not been maintaining any funds in my account but she has maintained around Rs 55000 (£600.00) in her account since 1st May 2012 in India. Is this enough or even I have to show the maintenance of any funds.

2. Can this fund be shown in different accounts or has to be be in her one account ??

3. She plans to get into full time study after coming here- will she be able to change into Tier 4 category from Tier 2 Dependent ??

Kindly help URGENTLY..

she doesn't need to be a tier 4 migrant in order to study - she can study full time on a tier 2 dependent visa.

Rajeev,
You need to maintain 900+600=1500 GBP (After 14th June 2012) in your account for 3 months or Get a letter from your A rated sponsor saying that they will maintain your family for 1 month.

Make sure that your Sponsor has ticked "Yes" option for Maintainance in COS issued to you.

Yes, you need to show £900.00 for you and £600 for your wife.

Otherwise get a letter from your A rated sponsor...

No, that is completely incorrect. Where the main PBS migrant already has leave and is not making an application, there is no requirement for maintenance from the PBS migrant in addition to that of the dependant.

Please read the rules and guidance as previously suggested.

Thanks guys, I believe I don't have to maintain any funds, while finance is maintaining Rs 55000 in her account- equivalent to £600. One more question- If my Sponsor gives me a letter that they will support her for the first month if needed, will she still have to maintain the balance or just providing the letter will do ?

Dear All,

I am now trying to get a letter from my A rated sponsor to support the meinatainence for my wifes dependent visa. However when my cos was generated on Mar 2012 my company had not ticked maintainance sponsor Y in my COS. My question is can they still give a letter to support the mainatiance for my wifes visa. Kindly reply at the earliest.

Rajeev,
Maintenance need to be confirmed in COS, In my case my sponsor forgot to tick yes option in maintenance in COS, but he contacted UKBA helpline and found he cannot change the COS once issued, hence helpline suggested to maintain funds in my account for 3 months.

I have maintained funds for me and my wife for 3 months.

Also I have got letter from my sponsor that they will maintain my family for one month (To be safer side)

I suggest you to take both letter from sponsor and maintain fund in your wife or in your bank account.

Thanks
